Accepting these terms
By creating a Brainy account or otherwise using Brainy, you agree to these Terms of Service and to the Privacy Policy and Acceptable Use Policy, which are incorporated here by reference.
Your account
You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity that happens under your account. Tell us promptly if you believe your account has been compromised. Brainy requires a password and, for destructive actions such as account deletion, an exact typed confirmation phrase — treat both as sensitive.
Acceptable use
Your use of Brainy must comply with the Acceptable Use Policy. Violating it may result in suspension or termination of your account.
Your content
You own the notes, tasks, projects and other content you create in Brainy ("your content"). You grant Brainy only the limited rights needed to store, process, and display your content back to you, and — solely when you explicitly trigger an AI feature and the deployment has AI enabled — to send the relevant portion of your content to the configured AI provider as described in AI & Your Data. Your content is never used to train Brainy's or any subprocessor's models.
AI-generated content
Some features let Brainy generate suggestions, summaries, action items or draft output using AI. AI-generated content can be incorrect or incomplete. It is always labeled as AI-generated, always retains the model and prompt version used, and always preserves your original content and source references separately so you can review before relying on it. You are responsible for reviewing AI-generated content before acting on it.
Plans and billing
Brainy's current plans, pricing, and what happens if you downgrade are described on the Pricing page, which forms part of these terms for the plan you select. Billing details, invoicing, and payment processing are handled separately from this document.
Service availability
Brainy is provided on an "as available" basis. We aim for reliable service but do not guarantee uninterrupted or error-free operation.
Limitation of liability
To the maximum extent permitted by applicable law, Brainy and its operators are not liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these terms limits liability that cannot be limited under applicable law. This section, like the rest of this page, is a draft placeholder pending qualified legal review for your jurisdiction.
Termination
You may stop using Brainy and delete your account at any time from Account and data. We may suspend or terminate accounts that violate the Acceptable Use Policy or these terms. On termination, your right to use Brainy ends; your data is handled as described in the Privacy Policy.
Changes to these terms
Brainy may update these terms as the product evolves. Material changes will be reflected on this page, and continued use after an update constitutes acceptance of the revised terms.
